• Ask yourself: In mediation, does the neutral person make a binding decision, or do they help the two sides reach their own agreement? • Which option best describes a process that tries to avoid going to court while still using a neutral helper? • Look at each choice and decide: Who actually creates the final agreement—the parties themselves, a court, or an outside decision-maker?
• Verify which choice involves an impartial person helping both sides communicate and negotiate. • Check whether mediation normally involves a binding decision imposed on the parties or a voluntary agreement they reach themselves. • Eliminate any choice that clearly involves formal court litigation or binding arbitration, since those are not mediation.
